Welcome to The Together Test. It is operated by 2801333 ALBERTA INC., doing business as The Together Test (“we”, “us”, “our”). These Terms of Service (“Terms”) govern your access to and use of The Together Test website, products, and services (collectively, the “Service”).

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least the age of majority in your jurisdiction to purchase access to The Together Test. By using the Service, you represent and warrant that you have the legal capacity to enter into these Terms.

If you create or manage a group, you confirm that you have permission to invite the people you include.

2. Description of the Service

The Together Test is a group-focused personality assessment experience. One person (the “group owner”) purchases access and invites others to join a group. Group members answer individual questions and group voting questions. When all members complete the assessment, a group report is generated.

The Service is designed for personal insight, reflection, and group conversation. It is not a medical, psychological, or employment screening tool.

Group Interaction Risk. The Service involves shared group insights and may affect how participants perceive one another. You acknowledge that participation may lead to disagreement or discomfort. We are not responsible for any interpersonal outcomes, disputes, reputational impacts, or decisions made by you or others based on the results.

3. No Medical, Psychological, or Employment Advice

The Together Test does not provide medical, psychological, counseling, or legal advice. The information and results provided are for informational and educational purposes only.

You agree that you will not use The Together Test:

  • To diagnose or treat any medical or mental health condition
  • As a substitute for professional advice or therapy
  • As a tool for hiring, firing, promotion, or other employment decisions

You are solely responsible for how you interpret and act on the information in your report.

4. Accounts, Groups, and Access

Certain features of the Service require an account or group access link.

Group owners are responsible for:

  • Creating and managing their group
  • Inviting participants
  • Ensuring participants understand how their data will be used within the group

Participants are responsible for:

  • Providing accurate information
  • Keeping their access links private
  • Using the Service in a respectful way

We may limit, suspend, or terminate access to any group or user if we believe the Service is being misused or these Terms are being violated.

5. Payments and Pricing

Access to The Together Test may require payment. Prices, features, and inclusions may change over time. Unless otherwise stated:

  • All prices are listed in the currency shown at checkout
  • Taxes, if applicable, will be calculated at checkout
  • Access is typically sold per group or per purchased session, not as a subscription

6. Intellectual Property

The Together Test, including all questions, voting prompts, scoring logic, text, graphics, logos, and report designs, is our intellectual property or is used under license.

You agree that you will not:

  • Copy, reproduce, or redistribute the assessment items or report content for commercial purposes
  • Reverse-engineer or attempt to derive the underlying scoring or algorithms
  • Claim ownership over The Together Test name, branding, or proprietary content

You may download and print the reports created for your group for personal, educational, or internal group use.

7. Acceptable Use

You agree not to use the Service to:

  • Harass, abuse, or threaten any person or group
  • Post or share content that is unlawful, defamatory, or hateful
  • Attempt to gain unauthorized access to other users’ data or to our systems
  • Interfere with or disrupt the operation of the Service

We may monitor overall usage patterns to maintain and improve the Service, but we do not manually review individual responses except as required to troubleshoot technical issues or comply with law.

8. Privacy and Data

Our use of your data is governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you also agree to the Privacy Policy.

Within each group, some information (e.g., your name, chosen display color, and high-level results) may be visible to other group members as part of the group report experience.

8.1 Cookies and Analytics Consent

When you create or join a group and accept these Terms, you consent to the use of essential cookies and limited analytics cookies needed to operate and improve the Service, as described in the Privacy Policy.

If you are browsing without joining or logging in, optional analytics cookies are used only after you provide consent via the cookie banner.

9. Third-Party Services

We may use third-party tools (e.g., payment providers, analytics, email services) to deliver the Service. Your use of those tools may be subject to their own terms and privacy practices.

We are not responsible for third-party websites or services that are not under our control.

10. Disclaimer of Warranties

The Service is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we disclaim all warranties, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not guarantee that:

  • The Service will be uninterrupted, secure, or error-free
  • The results will meet your expectations
  • Any particular outcome will occur from using the Service

11. Limitation of Liability

To the maximum extent permitted by law:

  • We will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
  • Our total liability for any claims arising out of or relating to the Service is limited to the amount you paid for access to The Together Test in the 6 months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages; in such cases, these limits apply to the fullest extent permitted by law.

12. Indemnification

You agree to indemnify, defend, and hold harmless The Together Test and its owners, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or related to:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of another person or entity

13. Changes to the Service and Terms

We may modify the Service or these Terms from time to time. If we make material changes, we will update the “Last updated” date and may provide additional notice.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms.

14. Termination

We may suspend or terminate your access to the Service at any time if we believe you have violated these Terms, misused the Service, or if we need to do so to comply with law.

You may stop using the Service at any time. Some obligations (such as payment obligations and certain licenses) may survive termination.

15A. Dispute Resolution; Arbitration; Class Action Waiver

Please read this section carefully. It affects your legal rights.

Informal Resolution. Before filing a claim, you agree to contact us through the Contact page and attempt to resolve the dispute informally for at least 30 days.

Arbitration. Except for claims that may be brought in small claims court (if applicable) or claims seeking injunctive relief for misuse of intellectual property, any dispute, claim, or controversy arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, rather than in court.

No Class Actions. You and we agree that disputes will be brought only in an individual capacity and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.

Arbitration Rules and Location. The arbitration will be conducted in Ontario, Canada, in English, under rules suitable for consumer disputes. The arbitrator may award the same damages and relief that a court could award, but only to the extent necessary to resolve the individual claim.

15. Governing Law and Venue

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles. Unless arbitration applies (see Section 15A), you agree that any legal action or proceeding will be brought exclusively in the courts located in Ontario, Canada, and you consent to their jurisdiction.
